Terms and Conditions
These Terms and Conditions (the "T&C") govern your use of our application, in relation to the Open Network for Digital Commerce, for mobile and handheld devices ("Everything30") . For clarity, the Platform refers to any Platform owned/subscribed/used by everything30, not limited to websites, mobile applications, devices, URLs/links, notifications, chatbot, or any other communication medium used to provide services to Users.
Everything30 is owned and operated by Nikhil william. For the purpose of these T&C, wherever the context so requires, "Buyer(s)", "you", "You", "your", "Your", "user", or "User", "End User" shall mean any natural or legal person who shall transact on Everything30 by providing registration data while registering on Everuthing30 as a registered user using any computer system, phone or handheld device. The terms "everything30", "We", "we", "Us", "us", "Our" or "our" shall mean owner.
Users are requested to carefully read the T&C before using everything30 or registering on everything30 or accessing any material or information through everything30. By clicking on the "Proceed" button, or through the continued use of Everything30, Users accept these T&C of Use and agree to be legally bound by the same. If You do not agree to these T&C, You may not use the services on everything30, and We request You to uninstall everything30. By installing, downloading or even merely using everything30, You shall be contracting with Us and You signify Your acceptance to this T&C and other policies (including but not limited to the Cancellation & Refund Policy, Privacy Policy and Take Down Policy) as posted on everything30 and amended from time to time, which takes effect on the date on which You use everything30, and thereby create a legally binding arrangement to abide by the same.
we enables transactions on its everything30 application between Buyers and Sellers dealing in various categories of goods and services. ("everything30 Services"). You can choose and place orders ("Orders") on everything30, from a variety of goods and services ("Products") listed and offered for sale by various Sellers including but not limited to the restaurants, kiranas, retail stores, electronic stores, supermarkets, grocery stores etc. The goods and services are sold on a business to consumer basis only for personal consumption and not for resale.
we may facilitate the delivery of such Orders or completion of tasks at select localities of serviceable cities across India ("Delivery Services") provided by a Seller or by connecting third party service providers i.e. pick-up and delivery partners ("Logistic Partner") who will be responsible for providing the pick-up and Delivery Services initiated by the users of everything30 (Buyers or Sellers). For both Services and Delivery Services, we is merely acting as an intermediary between the Sellers and Buyers and/or Logistic Partners and Buyers/Sellers.
For the Delivery Services, we may charge the Buyer a delivery fee (inclusive of applicable taxes whenever not expressly mentioned) on behalf of the Logistic Partner/ Seller App/ party appointing the Logistic Partner, determined on the basis of various factors including but not limited to distance covered, time taken, demand for Delivery Services/tasks, real time analysis of traffic and weather conditions, seasonal peaks or such other parameters as may be determined from time to time.
Use of and access to everything30 is offered to Users upon the condition of acceptance of all the terms, conditions and notices contained in these T&C and Privacy Policy, along with any amendments made by us at its sole discretion and posted on everything30 from time to time and subject to the above, we grants Users a personal, non-exclusive, non-transferable, limited privilege to enter and use everything30.Eligibility
By accessing Everyhting30, You represent that:-
- You are 18 years of age or older;
- You are capable of entering into a contract /legally binding agreement;
- You have the right, authority and capability to enter into this T&C and abide by all the provisions of the "T&C" of our Services.
- You are not barred or otherwise legally prohibited from accessing or using services of our or its entities under the laws of India.
- You are not impersonating any person or entity, or falsely stating Your age or affiliation with any person or entity.
Without prejudice to the other legal remedies which we may avail, everything30 and its entities shall reserve the right to terminate Your contract to use everything30 in case of any incorrect representation of the above-mentioned conditions.
Amendments
we retains the right to modify or amend these T&C. You can access the latest version of these T&C at any given time on Everything30. You should regularly review the T&C on Everything30. Your continued use of and access to Everything30 shall be Your consent to such changes. In the event the modified T&C are not acceptable to You, You should discontinue accessing Everything30.Access to Everything30 Services
We will do Our utmost to ensure that availability of Everything30 will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet and third party intervention/services being provided, this cannot be guaranteed. Also, Your access to Everything30 may also be occasionally suspended or restricted for any reason whatsoever, including but not limited to repairs, maintenance, or the introduction of new facilities or services at any time without prior notice.
Account Registration
You may access everything30 by registering to create an account ("Account") If You use everything30, You shall be responsible for maintaining the confidentiality of Your display name and password, and You shall be responsible for all activities that occur under Your display name and password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete, or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this T&C, We shall have the right to indefinitely suspend or terminate or block access of Your account on everything30 and refuse to provide You with access to everything30. You shall be solely liable and responsible for all the activities undertaken under Your Account, and any consequences therefrom.
Your mobile phone number and/or e-mail address is treated as Your primary identifier on Everything30. It is Your responsibility to ensure that Your mobile phone number and Your email address is up to date on Everything30 at all times. You agree to notify Us promptly if Your mobile phone number or e-mail address changes by updating the same on Everyhting30 through a onetime password verification.Return, cancellations, exchange and refund
Everything30 will endeavour to assist Buyers who have bonafide disputes on the Products provided to them by the us. The return policy and return policy period depends on the product category.
Replacement: If at the time of delivery and/or within the applicable return policy period, if any defect is found, then the buyer of the product/s or service/s can ask for replacement of the product/s or service/s from us subject to the following terms and conditions;
- Notify Seller of any defects in the product/s or service/s at the time of delivery of the product/s and/or within the applicable return policy period and the same product/s will be replaced in return of the defective product/s.
- Replacement can be for the entire product/s or part/s of the product subject to availability of the same with us.
You may also return the Product in an order if:
- wrong item being delivered other than what You had ordered in an order or
- Items substantially damaged or deteriorated in quality at the time of delivery. You agree that You shall give Us all the requisite proofs including but not limited to images of Products having issues.
Following products shall not be eligible for return or replacement:
- Damages due to misuse of product;
- Any consumable item which has been used/installed;
- Products with tampered or missing serial/UPC numbers;
- Any damage/defect which are not covered under the manufacturer's warranty.
- Any product that is returned without all original packaging and accessories, including the box, manufacturer's packaging if any, and all other items originally included with the product/s delivered;
Cancellations: With regard to food and perishable items, You may cancel an order without charge at any time before we accepts the order. You cannot cancel the order post acceptance of order by us except if a) the Order could not be delivered within the estimated time while placing the order; or b) If we doesn't accept or cancels the Order due to reasons not attributable to Buyer, including but not limited to the store being closed, non-availability of items, store/restaurant being unable to service online Orders at that moment etc. In all other cases, You may cancel an order without charge at any time before the status of the order changes to "In-Progress" on everything30. everything30 reserves the right to look into the cancellation request of the Buyer and determine if such cancellation request falls under the conditions mentioned above. If everything30 is satisfied that the request fulfils any of the aforesaid conditions, then we shall process the cancellation request and refund any amounts paid by the Buyer.
we may cancel an order (in full or partially) for the reasons including shortage or unavailability of certain Products or force majeure events. In case we cancels any order, You will not be charged for such cancellations, and we will refund You for any payment already made.
everything30 reserves the right to cancel the Orders and initiate full refund to the customer in the following circumstances:
- The Logistic Partner is not available to perform the services.
- Any Item or product is not in stock
- If the transaction cannot be completed for reasons not in control of us.
You may request return of the Products, purchased from Us provided the Products are sealed/unopened/unused and in original condition within the return period (This will depend on the product and the Seller). Please note, the requests for returns will not be accepted post the respective product return period.
Refunds: You may sole discretion be entitled to a refund up to 100% of the Order value if the Order is not delivered due to a cause attributable to either to us, everything30 or the Logistic Partner or in the event packaging of an item in an Order or the complete Order, is either tampered or damaged and the Buyer refuses to accept at the time of delivery for the said reason, subject to our acknowledgement of the same. Please be informed that when You opt to cancel or return the Products, upon Our verification of the Products and the documents relating thereto, the refund amount for such Products which are eligible for return as per these T&C, will be processed within a period of seven (7) business days from the date of Us verifying and confirming the refund request. However, we possesses the right to retain the amount towards forward & reverse shipping charges and such other charges as required to compensate the associated cost thereupon from the amount refundable to the Buyer. Your refund will be processed only when the conditions as may be stipulated by Us are fulfilled. The refund amount will be credited to the source account or other presented options provided by us and chosen by You. You acknowledge that after initiation of refund, it may take additional time for Your refund to reflect in Your account which is subject to Your financial institution or payment gateway service provider terms and conditions.
we further reserves the right to collect a charge from You to compensate the Seller or Logistic Partner in cases of cancellations not attributable to us, the Seller App or the Logistic Partner including but not limited to:
- Wrong address provided by You;
- Unavailability of the Buyer at the time of Order delivery;
- Any other failure to deliver Order due to lack of information, direction or authorization from Buyer at the time of delivery.
All decisions with respect to refunds will be our sole discretion and in accordance with our internal refund policy and the same shall be final and binding.

Action would be taken basis Your interaction and response with the customer support flow as well as the valid proof submitted by You.
we reserves its right to initiate civil and/or criminal proceedings against a User who, files a invalid and/or false claims or provides false, incomplete, or misleading information. In addition to the legal proceedings as aforesaid, we may at its sole discretion suspend, block, restrict, cancel the display name and its related display names of such User and/or disqualify that User and any related users from availing protection through us. Any person who, knowingly and with intent to injure, defraud or deceive, files a fraudulent complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law.
